Transcript: In 2008, the government introduced an act amending the criminal code. It added mandatory minimum sentence for those who found guilty of various forearm cases. The act prohibited possession of a loaded prohibited firearm or possession of an unloaded prohibited firearm alongside ammunition. summary conviction: minimum sentence of one year. indictable offenses: minimum sentence of three years. # In 2011, Nur was tried at the Ontario Supreme court of Justice.He argued that the mandatory minimum sentence was unconstitutional as it violates section 12 of his rights and freedoms because it would capture certain behaviors falling short of criminal conduct. # The trial judge found that the mandatory minimum sentence was not unconstitutional. therefore, nur was sentenced for one day in prison. (as he has already served 26 months in custody- credited as double time). # In 2013, Nur appealed to the ontarion court of appeal. The court found that the mandatory minimum sentence is unconstitutional. Questions by Alvin Thomas Section 12: Cruel and Unusual punishment. R v. NUR Overview Everyone has the right not to be subjected to any cruel and unusual treatment or punishment. Summary # In jan 2009, Toronto police were informed that a threatening person was waiting outside the community center. # When an officer arrived , the respondent Hussein Jama Nur , a 19 year old high school student ran away and the officer gave him a chase. # During the chase, Nur threw a loaded semiautomatic handgun at the officer. # Nur was promptly arrested and the gun was recovered . # He was charged under section 95(1) under criminal code-- indictable offence. Rights violated Is it fair to have a mandatory minimum sentence for a firearm offence? Considering the fact that Nur has never fired using his gun, he was charged for the possession of a firearm. Is that justifiable? Do you think that Nur's rights and freedom is violated? summary conviction: offenses which are less serious because they are punishable by shorter prison terms and smaller fines. Boo Radely Modern Character Batman shares multiple traits with Boo Radley like Boo Being mysterious.Sense He was such a quiet character That know one really understood,It makes him like batman.Also Boo Radley symbolizes the overall Good,A great example is when Boo saves scout from crazy Bob.Batman Is a symbol of a hero who comes and save the day.This why batman and boo share similar traits.
