Transcript: To gain access to a child personal records there is a procedure you need to follow. This includes; A photo copy of the document needs to be taken, a written request form needs to be written to indicate what information out of the record you wish to have access to, a written disclosure form needs to be written requesting that you disclose all information given to you, and many more. Part of the developmental records includes sampling their work, and reviewing and writing up their progress reports and achievements. These records can be accessed by staff, the child and their parents. These records are usually kept in the classroom. Litigation is the process of taking legal action in order to support a particular right. Before a lawsuit is filed, the person filing the lawsuit demands that actions are taken in order to resolve the issue. When a person begins a lawsuit, the person starts a civil procedure. The lawsuit could go to a court trial which could resolve the matter. The data protection act of 1998 is an act of parliament. It defines the UK law on the processing of data of identifiable living people. The data protection act requires individuals and companies to keep personal information to themselves. It provides individuals to control information about themselves. Access to personal records The freedom of information act of 2000 is a act of parliament that creates a right of access to information held by the public authorities. The act came into full force on 1st January 2005. The act cost £35.5m in 2005. Litigation Freedom Of Information Act 2000 Signatures Suprised? :O Other records Parents can request access to their child's personal record. In this record it includes all the "third parties" related to the child. There is a 13 stage request process to get access to a individuals record. As a group we were not exepcting there to be so many steps in order to get access to a childs personal records. We didnt think the process to be so long. Confidentiality Policy Role within the nursery: In a confidentiality policy is has to mention all other parties involved. These people could include all students, volunteers, paid staff members, unpaid staff members and visitors within the placement/setting. Every party involved needs to sign a confidentiality policy to ensure any information they come across is kept confidential and they do not disclose any information given. Developmental Records When looking at a confidentiality policy, signatures need to be taken in proof that you have read the policy and understand everything included. The policy needs to be signed by the Nursery, the manager/proprietor and a role of signatory (for example a chairperson). The policy then needs to be dated as proof to when the document was looked at and signed.
